1. Acceptance of These Terms

These Terms of Service ("Terms") govern your use of www.shanebrumback.com, operated by Indie Forge Studio ("we," "us," "our"), along with our games, tutorials, memberships, AI chat assistant, Discord server, Discord bot, and YouTube channel (together, the "Services"). By using the Services you agree to these Terms. If you do not agree, please do not use the Services.

2. The Website, Games and Tutorials

We offer browser games, interactive demos, articles, and Three.js / WebGL tutorials with sample code. Content is provided for learning and entertainment. Unless a page states otherwise, you may use tutorial code snippets in your own personal or commercial projects, but you may not republish our tutorials, articles, games, or assets as your own or redistribute them in bulk.

3. Memberships and Premium Content

Some content, such as full source code, downloads, and premium tutorials, requires a paid membership. Prices, billing periods, and included features are shown at checkout. Memberships renew automatically until cancelled; you can cancel at any time and keep access through the end of the current billing period. Payments are handled by third-party payment processors. Except where required by law or stated otherwise at purchase, fees are non-refundable. Premium content is licensed for your own use and may not be shared, resold, or posted publicly. We may change membership features or prices with notice for future billing periods.

4. User Accounts and Google Sign-In

You may create an account or sign in with Google. You are responsible for activity under your account and for keeping your sign-in secure. When you use Google sign-in, we receive basic profile information (such as your name, email address, and profile image) from Google to create and manage your account, as described in our Privacy Policy. Your use of Google is also subject to Google's terms. We may suspend or close accounts that violate these Terms.

5. AI Chat Assistant

The site's AI chat assistant answers questions about our games, tutorials, and code. Its answers are generated automatically and may be inaccurate, incomplete, or out of date. Review any code or advice before relying on it. Do not enter passwords, payment details, or other sensitive personal information in the chat. We may log conversations to operate and improve the assistant, and we may limit usage to prevent abuse.

6. Discord Server, Discord Bot and YouTube Channel

The Indie Forge Studio Discord server, the Indie Forge Studio Discord bot, and our YouTube channel are part of the Services. When you use them you also agree to the terms and community guidelines of Discord and YouTube. In our community, be respectful: no harassment, hate speech, spam, scams, illegal content, NSFW content, or unauthorized advertising. Moderators may remove content and mute, kick, or ban members at their discretion. The Discord bot may process the messages, commands, usernames, and IDs you send to it only as needed to provide its features (such as role assignment, notifications, and answers) and to moderate the server. Comments you post on YouTube or Discord are your responsibility.

Except for content you submit and third-party material, the Services, including games, art, 3D models, videos, text, logos, and the Indie Forge Studio name, belong to us or our licensors and are protected by copyright and trademark law. Open-source libraries (such as Three.js) remain under their own licenses. You keep ownership of content you post, but you give us a non-exclusive, royalty-free license to display it as part of the Services. To report infringement, contact us at the address below.

As an Amazon Associate we earn from qualifying purchases. Some links on the site are affiliate links, including Amazon Associates links, and we may earn a commission at no extra cost to you. Purchases are made with the third-party seller and are subject to their terms.

The Services link to or rely on third-party sites and services (for example Google, Discord, YouTube, payment processors, and itch.io). We are not responsible for their content, policies, or availability.

The Services, including all games, code, tutorials, and AI output, are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted, error-free, or secure, or that sample code is suitable for production use.

To the fullest extent permitted by law, Indie Forge Studio will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us in the 12 months before the claim or US $50.

13. Termination

You may stop using the Services at any time. We may suspend or end your access if you violate these Terms or if needed to protect the Services or other users. Sections that by their nature should survive termination will survive.

14. Changes to These Terms

We may update these Terms from time to time. We will post the new version on this page and update the effective date. If you keep using the Services after changes take effect, you accept the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of Illinois, USA, without regard to conflict-of-law rules.
